Terms of Service | FLUX3 API

These Terms of Service ("Terms") govern your access to and use of the FLUX3 API and related documentation, dashboards, and services (the "Service"), operated by Flidel Technosoft ("we", "us"). By creating an account, generating an API key, or calling the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts and API keys

You must provide accurate account information and keep it current. You are responsible for all activity carried out with your API key, including activity by your employees, contractors, and end users.

Keep your API key secret. Do not embed it in client-side code, public repositories, or mobile applications.
Notify us promptly at [email protected] if you believe a key has been exposed.
We may rotate or revoke a key that we reasonably believe has been compromised or is being used in breach of these Terms.
You must be at least 18 years old, or the age of majority in your jurisdiction, to hold an account.

2. Acceptable use

You may not use the Service to generate, store, or distribute content that:

is sexually explicit, or depicts sexual content involving minors in any form;
depicts a real, identifiable person without that person's consent, including sexual, defamatory, or misleading depictions, and including deceased persons;
impersonates a real individual or organisation, or is intended to deceive as to its origin or authenticity;
infringes copyright, trademark, or other intellectual property rights, including generating protected characters or brand assets for commercial use;
promotes violence, terrorism, self-harm, or unlawful discrimination;
constitutes harassment, threats, or targeted abuse;
violates applicable law in any jurisdiction where you or your end users operate.

You also may not attempt to circumvent rate limits, resell raw API access without written permission, reverse engineer the Service, or use it to train a competing model without our prior written consent.

Where a content filter is offered as a request parameter, disabling it does not relieve you of your obligations under this section. You remain responsible for your output.

3. Plans, billing, and renewal

Subscription plans are billed in advance on a monthly basis and renew automatically until cancelled.
Pay-as-you-go usage is drawn from prepaid wallet balance at the rates published on the pricing page at the time of the request.
Plan quotas, where applicable, reset at the start of each billing period and do not roll over.
Prices may change on 30 days' notice. Changes take effect at your next renewal.
You are responsible for any applicable taxes, which may be added at checkout.

4. Generated content

Subject to your compliance with these Terms and with any applicable third-party model licence, you own the output you generate through the Service and may use it commercially.

Generative models can produce similar or identical output for different users given similar inputs. We make no representation that your output is unique, and we do not warrant that it is free of third-party rights. You are responsible for clearing rights before commercial use.

5. Third-party models and licences

The Service provides access to models developed by third parties, each carrying its own licence. Open-weight models may impose obligations that follow the output. Where a model's licence conflicts with these Terms, that licence governs use of that model. You are responsible for reviewing the licence for any model you call.

6. Availability and support

We aim to keep the Service available continuously but do not guarantee uninterrupted operation. Maintenance, upstream provider outages, and capacity constraints may cause degraded performance or downtime. Models may be added, deprecated, or removed as upstream availability changes; we will give reasonable notice of deprecations where practical.

7. Suspension and termination

We may suspend or terminate your access immediately, without refund, if you breach section 2, fail to pay amounts due, or use the Service in a way that risks harm to us, other customers, or third parties. You may terminate at any time by cancelling your subscription. Sections 4, 5, 8, 9, 10, and 12 survive termination.

8. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, legality, or suitability of generated output.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, in which case the limitations above apply to the fullest extent permitted.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, and reasonable legal costs arising from your use of the Service, your output, or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict of law rules. The courts of India have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections available to you locally.
